We provide pro-active legal services and legal advice to the Superintendent, Administrators and staff of School Districts regarding the laws and regulations that govern federal and state education, including the administration and operation of educational institutions, school athletics, instruction methods, programs, and materials. This includes issues relating to school faculty, staff, and students, such as school discipline and tenure, bullying, and discrimination based upon race, color, national original, sex, or disability in violation of the Equal Educational Opportunities Act, Title IX of the Federal Education Amendments of 1972, the Americans with Disabilities Act, the Individuals with Disabilities in Education Act, and New Jersey Law Against Discrimination (NJLAD) and Conscientious Employee Protection Act (CEPA).
Why School Boards Need Lawyers
Our attorneys will assist district officials to follow the complex state and federal regulations affecting schools, and to avoid costly litigation.
As your School Board Attorney we will:
- Advise the Superintendent of Schools and all Board of Education staff on all legal matters relating to the operations of the District and ensure compliance with laws and regulations.
- Provide in-service training regarding legal matters on the latest changes that affect district officials administrators and staff.
- Coordinates with other government agencies and ensure compliance with local, State and federal procedures and mandates.
- Provide assistance to outside counsel gather evidence, research, interpret policies and procedures, interview staff, and others to ensure proper information and material available to advise and defend the school district.
- Develop and maintain a recording system for documentation of the Districts legal matters and prepare reports.
- Advise the Superintendent of Schools regarding the legal scope of student discipline involving suspensions, student appeals, and certified and classified discipline and terminations.
- Advise District Administrators regarding carrying out policies and procedures established and approved by the Board and/or regarding the New Jersey Statutes Annotated for the purpose of ensuring that the school district operates within all laws, rules and regulations.
- Provide legal assistance and support to principals when needed to appear in juvenile court proceedings.
- Recommend changes in policies and procedures that comply with applicable Federal and State laws and the Department of Education regulations and/or assist the Board in reviewing and revising the Board policies.
- Assist Administration in educational proceedings to meet all Federal and State Standards.
- Investigate fraudulent practices involving Workers Compensation, Disability, and Special Education funding to out-of-district entities.
